The business operates under the name “Alizés évasion”, departing from Sainte-Rose, Guadeloupe.
2. Purpose
These Terms and Conditions of Sale govern the boat trip services offered by Alizés évasion in the Grand Cul-de-Sac Marin, departing from Sainte-Rose, Guadeloupe.
Any booking implies full and complete acceptance of these terms. When booking online, the customer confirms having read and accepted these Terms by ticking the box provided for this purpose.
3. Overview of the activity
Alizés évasion offers half-day boat trips aboard the boat L’Artiste, in the Grand Cul-de-Sac Marin. The trip lasts approximately 3.5 to 4 hours.
Trips are organised in small groups to ensure comfort, a friendly atmosphere, and safety.
The boat is a Commercial Utility Vessel (NUC) 7.50 metres long, licensed to carry up to 11 passengers maximum, in addition to the captain.
A half-day is not enough time to visit every stop. On the day of departure, your captain will help you choose 4 to 5 stops together from those on offer, based on your preferences and the sailing conditions on the day.
4. Prices
The prices for the trip are as follows, in euros and inclusive of all taxes:
Adult: €50 including tax
Child (up to and including 10 years old): €30 including tax
Prices are the same for local residents and visitors.
Certain months, particularly June and September, may have special rates or be available on request only.
Barnier tax. The Grand Cul-de-Sac Marin is located within the Guadeloupe National Park. As such, the “tax on maritime transport of passengers to protected natural areas” (known as the Barnier tax) is mandatory for every passenger. This tax is €1 per person and is not included in the amount paid online: it is collected on board on the day of the trip, in cash only (please bring exact change).
The price includes: the boat trip led by the captain.
The price does not include: the Barnier tax (€1 per person, paid on board), snorkeling equipment (fins, mask, snorkel), parking, or meals and drinks. Passengers wishing to snorkel are asked to bring their own equipment.
5. Booking and payment
Booking is required and is done online through the website.
The customer declares that they are of legal age and have the legal capacity required to enter into this agreement.
Payment for the service is made by credit card through a secure platform. The Barnier tax (€1/person) is not paid online but is collected on board, in cash, on the day of the trip.
The booking is confirmed once payment has been received. A confirmation email is sent to the customer summarising the trip details.
6. Minimum number of participants
Trips depend on a minimum of 8 passengers booked (out of 11 spots). If this number is not reached, the captain reserves the right to postpone the trip to a later date or offer a full refund.
Affected passengers will be informed as soon as possible and may choose between rebooking another available time slot or being refunded. No other compensation may be claimed on this basis.
To maximise your chances of the trip going ahead, we recommend choosing a time slot where other participants are already booked.
7. Attendance and timing
Passengers must arrive at the boarding point at least 20 minutes before the scheduled departure time, to allow time for the safety briefing.
Any lateness or absence at departure time will not entitle you to a refund or rebooking.
8. Weather conditions
Trips are subject to weather and sea conditions.
The captain has sole decision-making authority over whether a trip goes ahead, is postponed, or is cancelled for safety reasons. Their decision applies to all passengers.
If the organiser cancels or postpones a trip, the customer will be offered a rebooking or a full refund, with no other compensation available.
9. Cancellation by the customer
The customer may cancel their booking as follows:
— Up to 48 hours before the trip: full refund
— Less than 48 hours before the trip: no refund
In duly justified cases of force majeure, the situation may be reviewed on a case-by-case basis.
Any refunds are processed within 14 days, using the same payment method used for the booking.
10. Changes to the programme
For reasons of safety, weather conditions, or organisation, the captain may need to change the route, the choice of stops, or how the trip runs, without this entitling the customer to compensation.
11. Safety and conduct on board
Passengers must follow all safety instructions and the captain’s directions.
Wearing a life jacket may be required in accordance with current regulations or depending on sailing conditions.
Smoking is not permitted on board. Animals are not allowed on board.
The captain reserves the right to refuse boarding to, or remove from the trip, anyone who is intoxicated, under the influence of substances, or whose behaviour could compromise safety on board.
12. Minors
Children must be accompanied by, and remain the responsibility of, an adult for the entire duration of the trip.
13. Health of participants
Passengers must make sure that their physical condition allows them to take part in a boat trip.
Because of the risks involved in sailing, passengers must inform the captain, before boarding, of any particular health condition: pregnancy, back problems, heart problems, or any other condition. Each passenger must also tell the captain whether or not they can swim.
This information allows the captain to adjust the trip accordingly. The captain reserves the right to refuse boarding if the safety of the person or the group cannot be guaranteed.
14. Liability
Alizés évasion cannot be held responsible for the loss, theft, or damage of personal belongings during the trip. Passengers remain responsible for their own belongings throughout the activity.
The passenger is responsible for any damage they cause, through their own fault or carelessness, to the boat, equipment, or facilities made available to them.
15. Force majeure
Alizés évasion cannot be held liable for any failure to perform or delay caused by a case of force majeure, as defined under French law and case law (including, in particular, exceptional weather conditions or an administrative ban on sailing).
16. Insurance
The activity is covered by professional civil liability insurance taken out with Helvetia Assurances, in accordance with the regulations applicable to Commercial Utility Vessels (NUC).
Given the cancellation conditions (Article 9), customers are also advised to personally take out cancellation insurance and/or personal accident insurance covering water sports activities.
17. Right of withdrawal
In accordance with Article L221-28 of the French Consumer Code, the 14-day right of withdrawal does not apply to leisure services provided on a specific date or according to a set schedule.
18. Personal data
The data controller is A.A.L AUX ALIZES LOCATIONS (contact@alizes-evasion.com). Data collected during booking is used solely to process the booking and manage the customer relationship.
It is not shared with third parties for commercial purposes; it may be processed by technical service providers strictly necessary to deliver the service, in particular the secure payment provider.

19. Complaints
For any complaint, customers are invited to contact Alizés évasion first, in writing, using the contact details given in Article 1, in order to seek an amicable solution.
20. Mediation
In accordance with the provisions of the French Consumer Code on “consumer dispute mediation”, if you have contacted us and are not satisfied with our response, you may use a free consumer mediation service provided by:

21. Governing law
These terms are governed by French law.
In the event of a dispute that cannot be resolved amicably, the competent courts will be those of the jurisdiction where the company’s registered office is located.
